Baby wrongly declared dead dies, father refuses body

A newborn baby who was "mistakenly" declared dead by doctors in India's capital Delhi has died in another hospital where he was being treated.

Asked to respond to the allegation by the father that no one from the Delhi government approached the family to help, he said, "There are certain legalities involved but we responded immediately and took action".

On November 30, a woman had given birth to the boy and a stillborn girl at the Shalimar Bagh hospital.

The baby boy, born on November 30 at Max Hospital, died at a nursing home in Pitampura on Wednesday.

"We are shaken and concerned at this rare incident", said a spokesperson for the private Max Hospital. The hospital wrapped the two bodies in two separate paper bags and then handed over to the family in a polythene bag. When the parents were on their way to a crematorium to perform their last rites, they found that the boy was still alive, and rushed him to another hospital. The family has refused to take the child's body, demanding arrest of the erring doctors in the case.

The Delhi police said on Wednesday that it had transferred the case to its crime unit.

A medical negligence case was registered under Section 308 of Indian Penal Code (IPC) against the hospital. "I will not take my son's body until the two doctors are arrested, so that we get justice", he said.

CCI also found the hospital and BD Ltd prima facie guilty of selling syringes from the hospital's pharmacy at double the MRP.

Moments after the doctors were sacked, the privately run Max Hospital issued a statement saying that "this strict action has been taken on the basis of our initial discussions with experts". On December 2, Jain had said the hospital's licence could be cancelled if a probe found it guilty of medical negligence.

"We just learnt of the sad demise of the 23-week preterm baby, who was on ventilator support", Max Hospital said according to PTI. It has found the Max of not following prescribed medical norms in dealing with newborn infants. Our deepest condolences are with the parents and other family members. "We wish them the strength to cope with their loss".
