"Although we would have preferred the Supreme Court to let the cases proceed below to a remedy, we are heartened by the decision of the Supreme Court to leave open the question of its jurisdiction", Perales said in a statement. Citing the need to provide election administrators with clarity on district boundaries, the state had argued in legal briefs that the Supreme Court risked throwing "the Texas election deadlines into chaos" if it allowed the redrawing of the state's maps to move forward prior to the March primary vote.

Various trade groups and 35 states had urged the high court to take up South Dakota's appeal. It found similarly that the state's legislative district maps were flawed.

The 2011 maps, which the San Antonio judges also ruled were drawn to weaken the strength of Hispanic and black voters, never took effect.

Texas Attorney General Ken Paxton praised the high court's action, calling the lower-court rulings "inexplicable and indefensible" and saying they could produce electoral chaos if allowed to stand in an election year.

Eric Holder Jr., chairman of the National Democratic Redistricting Committee and USA attorney general under former President Barack Obama, said the Texas case gives the Supreme Court a chance to send the message that "racial gerrymandering and intentional vote dilution is unconstitutional and diminishes the voice of minority citizens". Rafael Anchia, a Democrat and chairman of the Mexican American Legislative Caucus, which is a plaintiff in the case. Their most recent precedent from neighboring North Dakota was handed down in 1992 - "before Amazon was even selling books out of Jeff Bezos's garage", lawyers for South Dakota told the court. Then, to help boost their chances, lawyers for the state helped to solicit 15 "friend of the court" briefs from retailers, states, economists and others even before the justices chose to hear the case. "A full and fair review by the Supreme Court may not only confirm racial discrimination but could ultimately lead to the overt partisan gerrymandering apparent in the maps being corrected".

Because the Quill precedent was still binding, the state conceded that it could not win the case.

In urging the justices to ratify the decision by the three judges, civil rights groups said that nearly all the districts at issue were originally adopted by Texas lawmakers in 2011 and were rife with racial bias.

The state has been operating under temporary court-ordered maps drawn for the 2012 elections and adopted by the Legislature in 2013.

The Supreme Court has ruled on multiple occasions that race can not be a major factor in the way lines are drawn, but it has yet to set a standard for how much politics is too much.
