Kathua rape/murder case: SC asks J&K govt to protect victim's family, lawyer

Earlier in the day, the victim's father approached the Apex Court seeking transfer of the case outside Jammu and Kashmir. The 08-year-old girl was held captive in a temple, sedated and gang-raped multiple times before being murdered by the accused.

The bench also ordered the state government to provide escalated security cover to the lawyer and family of the deceased eight-year-old girl. He has demanded that the case, which has led to a country-wide uproar, be shifted to a court outside Jammu and Kashmir.

It considered the plea that security personnel, who will guard the family members, their lawyer and the family friend, should be in plain clothes.

After facing flak for his silence, PM Narendra Modi on Friday said, "The incidents of the recent days are a challenge to social justice". The state government is expected to reply before 27 April.

"I will have to be heard on this aspect (transfer of trial ). In the absence of the same, we don't want to enter into who is to investigate the matter", remarked CJI Dipak Misra. "Her soul will rest in peace if there is justice", he said.

"Investigation is nearly complete". A separate chargesheet was filed for the juvenile. The police have arrested eight people, including four police personnel - a head constable, a sub-inspector and two special police officers - in the case and filed charges against seven of them.

The eighth accused is a juvenile who moved a bail application before the chief judicial magistrate.

He said shifting of the case to either Chandigarh or any other place in rest of the country is not advisable for the reasons that we have already the experience of the trial of 2006 sex scandal after the shifting of that case to a Chandigarh court. I am the father. We are satisfied with a state police probe. Every accused has been identified.

She added that she has been called anti-Hindu and boycotted socially.

During the hearing, it was clarified that the petition was filed by the victim's father and Delhi-based lawyer Anuja Kapur.

It does not have any legal sanctity as evidence until a court gives permission to conduct these tests. "By taking swift and strict actions, please show that the Indian government's initial silence and delayed response to these horrific crimes against humanity are not a support of the accused because the accused have some or the other link with those in power", the group letter says.

A student of Bluebells International School spoke about how the concept of childhood being safe had been turned upside down by the Kathua rape case: "The fact that she, as a child, was brutally raped is appalling".
