Will Reuben Foster be welcome at 49ers offseason program?

The 49ers indicated Thursday no immediate action will be taken against linebacker Reuben Foster after he was formally charged with felony domestic violence.

The Santa Clara County District Attorney's Office cited for its decision to drop the ammunition charge a recent injunction issued by the U.S. District Court for the Southern District of California in San Diego, which is pending review by the U.S. Court of Appeals for the Ninth Circuit.

Both the Santa Clara County district attorney's office and Foster's defense team seem resolute in their respective positions with assistant district attorney Kevin Smith signaling Thursday that he would go ahead with the trial even if Foster's girlfriend refuses to testify, something that has undermined the prosecution in previous assault cases involving 49ers players. It is alleged Foster "inflicted great bodily injury, forcefully attempting to prevent a victim from reporting a crime", according to the DA's office. When officers arrived, the girlfriend told them that Foster had dragged by her hair, physically threw her out of the house and punched her 8-10 times in the head.

Foster was arraigned Friday in a San Jose courtroom, where Judge Nona Klippen ordered him not to contact the 28-year old girlfriend. Foster remains out of jail on $75,000 bail and will return to court on April 30 for a plea hearing.

The woman was bruised and sustained a ruptured ear drum, according to the report.

Foster was arrested the morning of February 11 at a home on Shannon Road in Los Gatos after the woman, who has been in a relationship with Foster for several years, flagged down a stranger's auto to get help calling 911. Foster just finished a solid rookie season and was expected to be a key part of the 49ers defense going forward. He is scheduled to meet with the team this week, a sitdown that could determine his future with the franchise. Foster was eventually arrested without incident. At this point San Francisco does not have a defined plan for how to give Foster structure while away from team activities, per Trotter, but that is something the 49ers hope to finalize when meeting with Foster. "Our office handles between four and five thousand domestic violence cases each year".

After pre-draft incidents past year, Foster was already on a short leash.

The 49ers are still taking a wait-and-see approach to Foster's legal plight.
