Federal Judge Rules In Favor Of Trump In Stormy Daniels Defamation Lawsuit

"The Court agrees with Mr. Trump's argument because the tweet in question constitutes "rhetorical hyperbole" normally associated with politics and public discourse in the United States".

Trump and a White House spokesperson have denied having an affair with Daniels.

Daniels has said she had sex once with Trump in 2006, and carried on a friendship with him for about a year.

Stormy Daniels, the porn star who claims to have slept with U.S. President Donald Trump over a decade ago, talks with a journalist during an interview in Berlin last week.

President Trump's counsel Charles J. Harder was pleased with the ruling and said Daniels should pay up for legal fees.

Ms Daniels' lawyer, Michael Avenatti, said they would appeal against the decision.

On Monday a federal judge dismissed the defamation lawsuit against the president.

Daniels is also suing Trump and his former personal attorney Michael Cohen over the $130,000 payment made to her to keep silent about the alleged affair in the weeks leading up to the 2016 election.

"There is something really rich in Trump relying on the First Amendment to justify defaming a woman", Avenatti said.

"The First Amendment (of the US Constitution) protects this type of rhetorical statement".

A USA judge has dismissed adult film actress Stormy Daniels' defamation lawsuit against Donald Trump and ordered her to pay his lawyer's fees, saying a tweet the President had written referring to her was protected by free speech laws.

Ms Daniels, who in August pulled out of an appearance on Celebrity Big Brother following a row with producers, alleges she was paid to remain silent over claims of an affair with Mr Trump.

Daniels' lawsuit over a hush-money deal is pending.

She later released a sketch of that man, which Trump posted on Twitter alongside a photo of Daniels' ex-husband.

Daniels, whose real name is Stephanie Clifford, sued Trump in April after he described her allegations of being threatened by a unidentified man in 2011 as a "a total con job".

Avenatti divulged more details about the mystery man during a Tuesday afternoon appearance with CNN's Jake Tapper.

Daniels told 60 Minutes that she did not report the encounter to police at the time because she was scared.

This ruling does not pertain to legal action Daniels has pursued over a nondisclosure agreement she entered into about the alleged sexual encounter.
