Florida To Announce Lift on Medical Marijuana Smoke Ban

A Leon County circuit judge previous year agreed with patients and other plaintiffs that the smoking ban ran afoul of a 2016 constitutional amendment broadly legalizing medical marijuana.

Saying they failed to heed the will of voters, Gov. Ron DeSantis ordered Florida lawmakers Thursday to eliminate a ban on smokable medical marijuana and, if they don't comply, threatened to drop the state's appeal of a court ruling that found the prohibition ran afoul of a 2016 constitutional amendment.

Erdan, who heads a committee of Israeli government ministers charged with countering the Airbnb decision, last month sent letters to five governors in the United States, including DeSantis, urging them to express their opposition to the Airbnb decision and to take economic measures against the company. DeSantis added. "I want people to be able to have their suffering relieved and so I don't think this law is up to snuff".

If it doesn't do so by mid-March, he said he will drop an appeal filed under his predecessor, now U.S. Sen. Therefore, Former-Governor Rick Scott submitted an allure, which avoided flower sales from moving forward until the appeal was dealt with in court.

When 71 percent of voters approved medical marijuana in 2016, many thought smoking would be an option for patients.

Mayor Garbriel Groisman of the Village of Bal Harbour, which also passed a similar resolution, said, "Gov. DeSantis is doing the right thing both by enforcing the laws of the State of Florida and by showing true moral leadership". The state appealed that decision, leaving patients who smoke marijuana at risk of criminal penalties. DeSantis says he prefers horizontal integration, which would allow medical marijuana companies to specialize in certain aspects of the business.

"I'm announcing today is the lawsuit that's challenging the smoking ban, we're going to be filing a stay of decision on that till mid-March", the governor said.

Medical marijuana advocates agree, but only if the change actually happens.

Regarding his trip to Israel, DeSantis said it would likely occur after the annual Legislative session in Tallahassee wraps up in May.

DeSantis also stated he wants the amended law to address licensing limits.

"Look, we've got a lot of fish to fry in Florida", DeSantis said.

Orlando trial attorney John Morgan, who led the drive to pass the amendment, argues smoking was included as a method of ingesting medical marijuana.

DeSantis said he wants to make sure the amendment is carried out "in a way for the folks that voted for it that they can feel that that's what they voted for".

"I was the principal architect of our state's medical marijuana laws and I am here to confess that those laws need to change", said Panhandle Congressman Matt Gaetz.
