Protesters call for justice for Eric Garner on anniversary of his death

A NY police officer accused of placing a 43-year-old black man in a banned choke hold just before his death in 2014 will not face federal charges, the government said, in a decision slammed by the victim's family as an "insult". 11 times before releasing balloons in her father's memory.

"This should have been taken care of years ago", said Garner's mother, Gwen Carr, a vocal police reform advocate since her son's death.

The marchers on Wednesday chanted and held signs saying "I Can't Breathe", a reference to Garner's dying words, as they marched past federal courthouses. "This present day, we can no longer breathe". Pantaleo maintained he used a legal takedown manoeuvre called the "seat belt".

"Significantly, Officer Pantaleo was not engaged in a chokehold on Mr. Garner when he said he could not breathe, and neither Officer Pantaleo nor any other officer applied a chokehold to Mr. Garner after he first said he could not breathe", Donoghue said.

His family then turned to the Justice Department to consider whether federal criminal or civil rights charges could be brought against one or more officers in the case. The city of NY settled with Garner's estate for $5.9 million in 2015.

Echoing the feedback of Garner's family, Mr de Blasio said in a assertion that the justice department had failed the metropolis.

"They came in that room and they gave condolences", daughter Emerald Garner said.

"What happened to Eric Garner is a tragedy".

Wednesday is the fifth anniversary of Eric Garner's death, an event that helped fuel the Black Lives Matter movement.

His phrases grew to change into a rallying weep for Dim Lives Matter protesters and other police reform activists. Athletes like National Basketball Association star LeBron James bore the message on T-shirts in support of the cause.

Garner's friend, Ramsey Orta, recorded the confrontation on his cell phone as it quickly escalated.

One of the cops involved in Garner's arrest, Daniel Pantaleo, had his arm tightly around the suspect's neck, while another pressed his head to the pavement. He repeatedly gasped, "I can't breathe", but the brutality continued, and he died shortly afterwards. A quarter of the victims, like Garner, are African-American, but an even greater number are white. "He was a ticking time bomb and set these facts in motion by resisting arrest". The other officers were aggressive, young police officers, he said. "This was a regular patrolman doing regular police work".

The refusal of the authorities to bring charges in the vast majority of police killings stems above all from the role of the police as the enforcers of the capitalist status quo.

The police union which is representing Pantaleo in a still unresolved NYPD departmental trial hailed the decision. If he's found to have put Garner in a chokehold, a move prohibited by the department, he could lose his job. The Civil Complaint Review Board (CCRB) repeated its stance to for Pantaleo to be fired.

"I'm not issuing an opinion because I respect that this process has to play out", he said of the pending verdict in Pantaleo' disciplinary trial.

The deem has yet to ship a recommendation to the police commissioner, who will establish the closing resolution about whether to discipline or fire Mr Pantaleo.

"It doesn't do a lot. And what I regret was believing that the old rules still applied", de Blasio said.

"If we just sit aside on the sidelines and let it go, it's going to keep on happening".
