SC stalls resignation, disqualification of rebel K’taka MLAs till Tuesday

He explained, "I need time since if the resignations are accepted, the MLAs' disqualification from the party will be nullified".

Rohatgi alleged that the speaker has not decided on the resignations of the lawmakers and the idea behind keeping the issue alive and pending was to bind them with the party whip.

He has to decide whether they have to be disqualified or not, only then resignation and other issues will come in. He said prior to accepting resignations, the Speaker was bound by rules to inquiry and ascertain whether the resignations were voluntary or were being tendered because of payment of money or through coercion.

The bench asked if the speaker had the power to challenge the Supreme Court's order.

"The occasion is such that, I have to say this, I can continue only if I enjoy the trust of the House".

The SC took note of the substantial questions of law of constitutional importance raised by the Speaker and said it would deal with them after detailed arguments on Tuesday.

Several corruption allegations against the state government have been levelled in the plea of the rebel MLAs while securing a judicial order, Dhavan said.

The rebel MLAs of the Congress-JD (S) coalition have returned to the Renaissance Hotel in suburban Powai, where they would be staying for another two days. While denying the charge of rebel MLAs that he had made himself scarce on July 6 so as not to receive the resignations, the Speaker narrated in detail what transpired last week and brought to the court's notice that disqualification proceedings were pending against all 10 MLAs.

The rebel Congress MLAs were also supposed to be present in the Assembly session, which is now underway.
